2. Alcohol and responsible service
2.1 Marionette takes its legal responsibilities as a producer and seller of alcohol seriously.

2.3 You must not:
purchase alcohol if you are under 18;

supply alcohol to a person under 18.
2.4 By placing an order, you confirm that you are 18 years or older and legally entitled to purchase alcohol.

7. User submissions and feedback
7.1 If you submit or provide any material to us, including feedback, reviews, comments, photographs, videos, ideas, recipes or other content (“User Content”), you confirm that:
you own the User Content or have permission to provide it;
your User Content does not infringe another person’s rights;
your User Content is not unlawful, misleading, defamatory, obscene or discriminatory;
your User Content does not contain malware; and
you have obtained all necessary consents from identifiable people appearing in the User Content.
7.2 You retain ownership of your User Content.
7.3 By providing User Content to us, you grant Marionette a worldwide, royalty-free, non-exclusive, transferable and sublicensable licence to use, reproduce, edit, adapt, publish, display, communicate and distribute that User Content for our business, marketing, promotional and social-media purposes.
7.4 You consent to reasonable editing or adaptation of your User Content and agree that we may identify you by your name, username or other attribution supplied with the User Content.
7.5 We may remove or decline to publish User Content at our discretion.

8. Products, prices and orders
8.1 Goods, prices, availability and promotional offers may change at any time.
8.2 Prices are shown in Australian dollars unless otherwise stated and include GST where applicable. Delivery fees and other applicable charges will be disclosed at checkout.
8.3 An order submitted through the Website is an offer by you to purchase the selected Goods. Your order is not accepted until we confirm acceptance or dispatch the Goods.
8.4 We may accept or reject an order at our discretion, including where:

9.2 Payment is processed by third-party payment providers. Marionette does not store complete payment-card details unless stated in our Privacy Policy.
9.3 You authorise us or our payment provider to process payment for the Goods, delivery charges and any other charges disclosed at checkout.
9.4 If payment is declined or reversed, we may suspend or cancel the relevant order.
10. Delivery
10.1 We deliver to locations shown as available at checkout. Unless expressly stated otherwise, we do not deliver outside Australia.
10.2 Delivery timeframes are estimates only. We are not responsible for delays caused by events outside our reasonable control, including courier delays, weather, natural disasters, industrial action, incorrect addresses, access problems or regulatory requirements.
10.3 You are responsible for providing a safe and accurate delivery address and ensuring that an authorised adult is available to receive the Goods.
10.4 We may require an adult recipient to provide proof of age and identity and sign for delivery.
10.5 We may not leave alcohol unattended unless this is permitted by applicable law and expressly authorised by you. If you request unattended delivery, you accept the associated risk to the extent permitted by law.
10.6 If a delivery is returned, redirected or requires re-delivery because of an incorrect address, failed delivery, refusal of age verification or the recipient’s unavailability, additional charges may apply where permitted by law.
10.7 Risk in the Goods passes to you when the Goods are delivered to you or an authorised recipient at the nominated address, except to the extent otherwise required by the ACL.
10.8 Ownership of the Goods passes to you when we have received full payment and the Goods have been delivered or collected, except to the extent otherwise required by law.
11. Returns, refunds and consumer guarantees
11.1 Nothing in these Terms and Conditions excludes, restricts or modifies any rights or remedies you may have under the ACL or other applicable law.
11.2 Our Goods come with consumer guarantees that cannot be excluded. These may include guarantees that the Goods are of acceptable quality, match their description and are fit for any purpose made known to us.
11.3 If you believe Goods are faulty, damaged, unsafe, incorrectly supplied or do not meet a consumer guarantee, contact us at info@marionette.com.au as soon as reasonably practicable with:
your order number or proof of purchase;
a description of the issue; and
photographs or other evidence where relevant.
11.4 Depending on the circumstances and your legal rights, we may provide a repair, replacement, refund or other remedy.
11.5 If the Goods are not faulty and you simply change your mind, we are not required to offer a refund or exchange unless our separate Returns Policy says otherwise.
11.6 We do not accept returns of opened or partially consumed alcohol unless required by law or agreed by us.
11.7 We may require reasonable evidence of purchase and may ask you to return affected Goods for inspection. You should not return Goods without first contacting us for instructions.
11.8 Any voluntary returns or exchange policy published by Marionette operates in addition to your non-excludable legal rights.
12. Gift cards and vouchers
12.1 If we offer gift cards or vouchers, their expiry date, permitted uses, exclusions and other conditions will be stated at the time of purchase.
12.2 Gift cards and vouchers cannot be exchanged for cash except where required by law.
12.3 Gift cards and vouchers must not be copied, resold, altered or used fraudulently.
12.4 Gift cards and vouchers cannot be used to purchase alcohol by or for a person under 18.
13. Privacy and cookies
13.1 Our collection, use, storage and disclosure of personal information is governed by our Privacy Policy.
13.2 We may use cookies and similar technologies to operate, secure, analyse and improve the Website, subject to our Privacy Policy and applicable law.
14. Disclaimers and limitation of liability
14.1 To the maximum extent permitted by law, Marionette does not warrant that the Website will be uninterrupted, error-free, secure or free from viruses or other harmful code.
14.2 To the maximum extent permitted by law, Marionette is not liable for loss or damage arising from:
your inability to access or use the Website;
reliance on information published on the Website;
delays, interruptions or technical failures;
unauthorised access to your account or information;
third-party websites, services or content; or
events outside our reasonable control.
14.3 Nothing in these Terms and Conditions limits liability that cannot lawfully be limited, including liability under the ACL for consumer guarantees or liability for fraud, wilful misconduct or death or personal injury caused by negligence.
14.4 Where our liability may lawfully be limited, our liability is limited to the lowest of:
replacing the Goods;
supplying equivalent Goods;
repairing the Goods; or
refunding the price paid for the relevant Goods.
14.5 To the maximum extent permitted by law, Marionette is not liable for indirect, incidental, special or consequential loss, including loss of profits, revenue, business, goodwill, anticipated savings or data.
14.6 This clause applies only to the extent permitted by law and does not affect your non-excludable rights.
15. Indemnity
15.1 You indemnify Marionette and its officers, employees, contractors, agents, suppliers and related entities against claims, losses, liabilities, damages and reasonable costs arising from:
your breach of these Terms and Conditions;
your unlawful or negligent use of the Website;
your infringement of another person’s rights;
User Content supplied by you; or
your breach of any applicable law.
15.2 This indemnity does not apply to the extent that the relevant claim, loss or liability was caused by Marionette’s negligence, breach of these Terms and Conditions or unlawful conduct.
16. Events outside our control
16.1 We are not responsible for a delay or failure to perform an obligation where the delay or failure results from circumstances beyond our reasonable control.
16.2 These circumstances may include natural disasters, fire, flood, severe weather, epidemic, pandemic, supply shortages, transport disruption, industrial action, power or telecommunications failure, cyberattack, government action or changes in law.
16.3 If an event outside our control continues for an unreasonable period, we may cancel the affected order and provide a refund or credit for any amount paid for Goods that have not been supplied.

17.2 Changes apply from the date they are published, unless stated otherwise.
